PROCESSING OF PERSONAL DATA

The personal data collected within the scope of this current contest shall be processed by the PROMOTOR in the capacity of Joint Controller and in accordance with the following terms.

If you so wish, you may obtain information regarding the joint processing conducted by the PROMOTOR by sending an e-mail to info@ddm.pt.

Purposes of the personal data processing:

The personal data that are collected subsequent to the interest shown in the properties being sold shall be processed for the following purposes:

  • perform all the activities necessary for managing the process of purchasing and selling land lots;
  • provide clients with the information necessary for acquiring land lots.

Legal basis for processing the personal data:

The legal basis for processing your personal data is the use of the data for purchasing and selling land lots, as well as the legitimate interest of the PROMOTOR in guaranteeing the proper conditions for conducting its business.

Communication of the data to third parties:

The personal data processed by the PROMOTOR may be communicated to the following recipients, based on legal grounds for communication:

  • to judges, courts, consumer associations or any other third parties to which the PROMOTOR may be obliged to communicate information in the event of a legal dispute;
  • to third parties that supply services related to the construction of the villa (namely project manager, architect and contractor); these third parties may access personal data in so far as is deemed necessary for the supply of such services.

Personal data storage period:

The PROMOTOR shall store the personal data of the participants while the current sale is underway and after such a period, during the storage periods established in legislation that is applicable to compliance with the legal obligations that the promoters are bound to.

Rights of the data subjects:

Clients may exercise the following rights at any time:

(i) Request access to their personal data: you are entitled to obtain our confirmation regarding whether or not any personal data pertaining to you is being processed, and if that is indeed the case, request access to your personal data. Access information includes, among other things, the purposes of the processing, the categories of the personal data in question, and the categories of recipients or the recipients to whom your personal data were or will be disclosed. However, this is not an absolute right and the interests of other individuals restrict your right of access.

You may be entitled to obtain a copy of the personal data that are being processed.

(ii) Request rectification of your personal data: you are entitled to obtain from us the rectification of any inaccuracies in your personal data. Depending on the purposes of the processing, you are entitled to complete any of your incomplete personal data, including via an additional declaration.

(iii) Request erasure of your personal data: under certain circumstances, you may be entitled to have us erase your personal data and we may be obliged to erase said personal data.

(iv) Request restriction of the processing of your personal data: under certain circumstances, you may be entitled to obtain from us a restriction on the processing of your personal data. In such cases, the respective data shall be marked and may only be processed by us for certain purposes.

(v) Request data portability: in certain cases; you may be entitled to receive the personal data that you supplied to us, in a structured, commonly used and machine-readable format, and you may have the right to transmit those data to another entity without hindrance from us.

(vi) Oppose the processing of your personal data: under certain circumstances, you are entitled to object to the processing of your personal data.

The rights referred to above shall be exercised by sending a written communication to any one of the Controllers, accompanied by a photocopy of your citizen card or any other identification document, to any of the following addresses:

The copy of the citizen card or other identification document, in this case, shall only be used to prove the identity of the client, to rectify, cancel and object, and it shall be processed exclusively for such purposes, and it shall be eliminated once it is no longer necessary for such purposes.

Clients may also submit a complaint to the supervisory authorities in Portugal, namely the Portuguese Data Protection Authority, Avenida D. Carlos I, 134, 1º, 1200-651, Lisbon (www.cnpd.pt), particularly in view of exercising their rights.
